该书从中国传统诉讼当事人的主体地位和诉权这一理论命题出发,从诉前攻防策略,诉权启动艺术,案情声辩艺术和诉权推进策略4个方面,对当事人及其背后的讼师及第三方的传统诉权运作艺术作出了开创性研究.作者认为,中国传统诉讼艺术虽然对程序正义重视不够,并因此带来一定的负面影响,但总体上为维护当事人的合法权益,为实现社会的实质正义发挥了不可低估的积极作用,较大限度地满足了普通民众的法律需求.
