Ordered, that the Committee on the Judiciary be instructed to consider the expediency of providing by law that in all cases relating to the assessment of damages by jury, occasioned by the location of roads, canals or railways, or flowage, it shall be the duty of the sheriff and not of his deputy, to summon and empannel the jury, and to preside at the trial, with all the authority and duties that the judges of the Court of Common Pleas now have as to matters of law.
