"El derecho fundamental colectivo al conocimiento tradicional en las comunidades negras de Colombia garantizala generaci̤n de conocimientos cient̕ficos resultado de procesos culturales que dan testimonio e identifican su conciencia hist̤rica y dial̤gica, y que estas comunidades han tenido que establecer para la pervivencia en sus territorios colectivos. De ah̕ que este libro analice los fundamentos conceptuales, ̌ticos y jur̕dicos de este derecho, que no lo hacen exigible desde la individualidad, sino desde el conjunto poblacional que se autorreconoce como tal y que comparte un pasado, una experiencia cultural y ̌tnica que justifica ese trato diferencial, fundamentado en la necesaria aplicaci̤ndel principio de diversidad e integridad ̌tnica y cultural. Con este estudio interpretativo se le presentan al p︢blico lector aquellas situaciones de tensi̤n, relacionadas conla apropiaci̤n individual del conocimiento tradicional en comunidades negras y los mecanismos jur̕dicos de reconocimiento de propiedad intelectual sobre el conocimiento; al igual que se caracterizan y se establecen las afectaciones en el ejercicio del derecho estudiado para el sujeto colectivo ̌tnico del pa̕s."
"The fundamental collective right to traditional knowledge in Black communities of Colombia guarantees the generation of scientific knowledge resulting from cultural processes that testify and identify their historical and dialogic conscience and that these communities have had to establish for their survival in their collective territories. Hence, this book analyzes the conceptual,ethical, and legal foundations of this right, which make it not enforceable from individuality but from the population at large that recognizes itself as such and shares a past, a cultural and ethnic experience that justifies this differential treatment based on the necessary application of the principle of diversity and ethnic and cultural integrity. This interpretative study presents to readers situations of tension related to the individual appropriation of traditional knowledge in Black communities and the legal mechanisms of recognizing intellectual property overknowledge. It also establishes and characterizes issues in exercising the studied right for the country's ethnic collective subject."
