"The standing committee on the Judiciary to whom was referred Senate bill No. 58, 'declaratory of the forty sixth section of the act entitled, an act relating to wills,' have had the same under consideration and report: That the preamble to said bill assumes, that doubts have arisen under the said forty sixth section, whether, when a widow fails to elect to take under a will in lieu of dower, she shall be entitled to a share in the personal estate to the exclusion of legatees, or only a share in such of the personal estate as remains bequeathed."--Page 1.
