Summary
1840 memorial of the Literary Fund requesting that the legislature pass an act authorizing the fund to receive and hold the estate of Martin Dawson for the devises listed in the will, and for expenses associated with this will. Of note this action resulted following a ruling by the court on the meaning of the relevant provisions.
Note
"Second Auditor's Office, December 7th, 1840. ... The memorial now presented is, in all respects, the same as that presented to the legislature on the 20th January 1840, but not definitively disposed of, and will be found with the accompanying papers amongst the printed documents of the house of delegates of that year, numbered 39. The large amount of property claimed to be devised by the will of Martin Dawson for the purposes of education in the counties of Albemarle and Nelson, calls in the opinion of the directors of the Literary fund for the early consideration of the subject by the legislature. ...
